British Education Virtual Academy (BBEVA) is an independent Tutoring Academy for boys and girls of all ages. Tutees can be situated both in the UK and abroad.

This privacy notice sets out how BBEVA uses and protects any information that you give us or that we request for legitimate reasons. 
BBEVA is committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified, then you can be assured that it will only be used with this privacy policy. BBEVA may make changes, from time to time, by updating this policy on the website. You should check the website from time to time to ensure that you are happy with any changes. Where there are substantive changes that will affect your rights, they will be communicated to you as far as is reasonably practicable. This policy is effective from January 2023. 

What is this policy for? 

This policy is intended to provide information about how the Academy will use or process personal data about individuals who are connected to the Academy both now and in the past. This information is provided in accordance with the rights of individuals under the General Data Protection Regulation. (GDPR) Act. 
For example. 
Any contract between the Academy and its staff or the parents of tutees. 
The Academy's policy on taking, storing and using images of tutees.  
The Academy's storage and retention of data policy.  
The recording and storage of incidents and concerns. 
Anyone who works for or acts on behalf of the Academy should be aware of and comply with this privacy notice.

All staff at BBEVA share responsibility for data protection. 

Why the Academy needs to process personal data. 

In order to carry out its duties as part of its daily operation to staff, tutees and parents, the Academy may process a wide range of personal data about individuals, including current, past and prospective staff, tutees and parents.  Some of this activity is needed to carry out the Academy's legal duties and obligations.  
Other uses of personal data will be made in accordance with the Academy's legitimate interests.

Results of tests and examinations taken by tutees

Details involved with Safeguarding – Eg DBS checks.

How the Academy collects data.  

Generally, the Academy receives personal data from the individual directly, or in the case of tutees, from their parents. This may be via a form, or simply in the course of ordinary interaction or communication such as e-mail, telephone, or conversations. However, in some cases, personal data may be supplied by third parties, for example, from another school or from other professionals who have worked with an individual. 

Who has access to personal data and who does the Academy share it with? 

Personal data collected by the Academy will remain within the Academy. It will be processed by appropriate individuals and shared only on a need-to-know basis. Occasionally, the Academy will need to share personal information relating to its community with third parties such as schools, professional advisors or Government Agencies such as the Police or HMRC. 
Particularly strict rules of access apply in the context of medical records and pastoral files, such as safeguarding. 
Staff, tutees and parents are reminded that the Academy has to follow legal and statutory guidance to record or report incidents and concerns that arise or are reported to it. 

How long do we keep personal data?  

The Academy will return and retain personal data securely and only in line with how long it is necessary to keep it for legitimate and lawful reasons. The Academy follows the legal recommendation for how long to keep personnel files following departure from the Academy. However, incident reports and safeguarding files will need to be kept much longer in accordance with specific legal requirements. Please contact the Academy if you have any specific queries about how this policy is applied. 

Your rights. 

Individuals have various rights under data protection law to access and understand personal data about them held by the Academy.  
These rights are subject to certain limitations and exemptions. Any individual wishing to access or amend their personal data should put their request to the Academy. 
You should be aware that certain data is exempt from the right of access. This may include information which identifies individuals, or information which is subject to legal, or professional privilege. The Academy is not required to disclose any confidential references given by the Academy for the purpose of the education, training, or employment of any individual. Everyone who has information and data held by the Academy can put in a subject access request on their behalf. 

Data accuracy and security.  

The Academy will endeavour to ensure that all personal data held in relation to an individual is as up-to-date and accurate as possible. Individuals must please notify the Company of any changes to their personal data. An individual has the right to request that any inaccurate or out-of-date information about them be erased or corrected, subject to certain exemptions and limitations - as above.
